A Massachusetts doctor has been indicted on two counts of rape by a grand jury in Massachusetts after brave survivors came forward to share their story.
Middlesex County District Attorney's Office confirmed the indictment in a press release, stating that the allegations involve the sexual assault of two former female patients during the course of medical examinations.
A civil lawsuit was also filed against the rheumatologist, Dr. Derrick Todd. In addition to Dr. Todd, the lawsuit names Charles River Medical Associates, P.C. and Brigham and Women's Faulkner Hospital, Inc. as Defendants.

How Can a Hospital be Held Liable for a Doctor's Actions in a Medical Malpractice Claim?
Hospitals have a legal responsibility to ensure the safety and wellbeing of their patients, which includes monitoring the conduct of their staff, like doctors. If a doctor engaged in misconduct, such as abuse or malpractice, and the hospital fails to act appropriately, the institution may be held civilly liable for their inaction.
This can occur when a hospital is aware of complaints or warning signs about a doctor's behavior but does not take reasonable steps to investigate, intervene, or remove the doctor from his position.
For example, in the case of Dr. Todd, the hospital received anonymous complaints about his conduct and launched an investigation, which ultimately led to the doctor's termination of employment. But, if the hospital had knowledge of Dr. Todd's behavior for a longer period and did not take proper action, the hospital may be civilly responsible for the victim's injuries. Right now, the attorneys are in the discovery phase of litigation, so only time will tell.
In Wisconsin, and many other states, hospitals may be held accountable if it is proven that they either knew or should have known about the abusive behavior and failed to intervene. Hospitals have a duty to prevent harm and protect their patients from dangerous medical professionals.
